According to authorities the automobile collision occurred in the 13300 block of Foothhill Boulevard in the vicinity of Fernmont Street in Sylmar. According to Los Angeles Fire Department Capt. Bennington the fire fighters were responding to a crash at the time of the collision, when the driver suspected of driving under the influence collided with back of the fire truck.

The crash that the Los Angeles Fire Department fire fighters were originally responding to had struck a mailbox, a parked car, a telephone pole and then crashed into a fire hydrant. According to Capt. Bennington, this driver is also suspected of having been driving under the influence.
Fire department responders at the scene stated the woman was driving at a high rate of speed at the time of the crash and was transported to a local hospital to be treated for injuries. The driver involved in the crash the fire fighters were responding to involved a man in his 30’s that was treated at the scene and arrested for suspicion of driving under the influence.

Recently I represented the family of a 29 year old man killed in Cincinnati by the alleged negligence of 3 defendants. We mediated the case. Mediation is where a neutral party is hired to help the parties negotiate a settlement. Evidence is not submitted, nor does the mediator have any power to impose a decision. If a settlement is reached it is the result of an agreement among the parties. Preparation for the mediation is very important. As a personal injury lawyer most of my mediations have been car accident injury claims. However, this one happened to involve a motorcyclist.

The First Person to Prepare Is Your Client

My client is the first person I need to prepare. They need to know how the mediation works. Since every mediator works a bit differently the best tip is to put the client at ease by telling them they won’t have to testify and the other side will not be asking any questions. Secondly you must talk to the client about money. You want to be on the same page with your client about what your ultimate goal is in dollars. That way you can form some strategy about what dollar increments you will move and where you might start . Often there may be some offer, but sometimes only the plaintiff (the party bringing the personal injury or in this case the claim for wrongful death) may have made a demand that has not been responded to.

You need to tell your client how to dress. The defense attorneys and the adjustors will be sizing up the family of the person wrongfully killed. This is an opportunity to put their best foot forward. If the injury victim is courteous and likeable then the defendant’s evaluate the case higher.

You Have Prepared Yourself and the Defense

It is essential that some material be exchanged prior to the mediation and work be done by the plaintiff so the defendant, more specifically the insurance company, has information to evaluate the case. We had taken over 25 depositions and had provided economist’s reports , and a clinical psychologist traumatic loss expert’s report to the other side.

You Chose Your Mediator Wisely and Prepared Them

If you can let the defendant suggest who they like let them. It’s critical in big cases to hire someone that has a good reputation and that has been used by all the lawyers involved. This helps everyone trust in the process if they trust the mediator. One of my favorite Cincinnati based mediator’s was a long time insurance defense lawyer. He knew how to value a serious loss and had the respect of the insurance lawyers and the insurance companies.

It is important to tell the mediator in writing the good points about your case and even provide them with reports of your experts if possible. If you can convince the mediator you have a strong case, the good mediators will use their power of persuasion to get you where you should be. But they need ammunition. So it’s a must to prepare a detailed mediation synopsis of your case. Mine was 7 pages long with several reports attached.

Not every case settles at mediation, but it can set the stage for a settlement as it gives the parties an idea of where each one wants to go. Some cases don’t settle, primarily because one party is mistaken in their value of the injury or wrongful death. For instance I was co-counsel on another wrongful death where the insurance company’s top offer at mediation was $100,000, and the jury verdict ended up $2.7 million.

Residents of Pennsylvania and New Jersey have probably heard the terms: Full Tort, Limited Tort, Verbal Threshold, and Limitation on Lawsuit Option. Few, however, likely understand what these terms mean and how the selection affects them.

In Pennsylvania, auto insurers are required by law to give consumers the option of selecting Full Tort or Limited Tort coverage. Full Tort coverage provides you and the members of your household with an unlimited right to make a claim for compensation if you are injured in a car crash. This coverage allows a person injured in a car accident to make a claim for economic damages (i.e. lost wages, medical bills) and non-economic damages (i.e. pain and suffering, inconvenience, loss of enjoyment of life) irrespective of the severity of the injury and impact that the crash may have. Limited Tort coverage restricts a person’s right to make a claim for accident-related injuries and damages. A person with limited tort coverage can still make a claim for all economic damages (i.e. lost wages), but can only make a claim for non-economic damages (i.e. pain and suffering) if the injuries result in a serious impairment of bodily function or permanent disfigurement. For all intents and purposes, the injury must be very serious or permanent, and significantly impact the person’s ability to attend to work or activities of daily living.

New Jersey has a similar dichotomy referred to as Limitation on Lawsuit and Non-Limitation on Lawsuit coverage. Previously known as the Verbal Threshold, the Limitation on Lawsuit option does exactly what is says: limits a person’s right to sue. Like limited tort coverage in Pennsylvania, the Limitation on Lawsuit option does not limit a person’s right to recover lost wages and medical bills, but does place limits on the ability to recover for non-economic damages like pain and suffering. A person can recover non-economic damages if the injury suffered is permanent or results in a permanent disfigurement. The No Limitation on Lawsuit option places no restrictions on the right to recovery much like full tort coverage in Pennsylvania.

Insurance companies and agents routinely encourage consumers to select Limited Tort and Limitation on Lawsuit coverage because of the cost savings. Consumers are rarely told about the rights they are giving up in exchange for nominal cost savings. Consumers need to understand that insurance companies have a vested interest in selling inferior coverage because it limits their exposure. Don’t do the insurance companies any favors: select Full Tort or No Limitation on Lawsuit coverage. Your family will thank you in the event you are in an accident.
